SD Councilwoman Emerald seeks
statewide regulation of pedicabs

SAN DIEGO (Press Release)-- Now that the San Diego City Council has voted on a tougher Pedicab Ordinance, City Councilmember Marti Emerald is seeking even stronger safety measures from the State Legislature. Councilmember Emerald chairs the City Council’s Public Safety and Neighborhood Services Committee and led the effort to strengthen the city’s pedicab regulations. Now she is looking for statewide reform.

Councilmember Emerald is working with San Diego’s legislative delegation to amend the California Vehicle Code. The proposed amendment would require pedicab operators to have a valid California Driver’s License.

Councilmember Emerald says, “It’s a step in the right direction to make sure our pedicab industry is safe and accountable”.

The City of San Diego began regulating pedicabs in January of 2000. As San Diego grew, so did the number of pedicabs. But all is not rosy with the popular mode of transportation. Many downtown residents and businesses, as well as pedicab passengers and even some pedicab company owners, complained of improper parking, lack of proof of insurance, and overcharging of fares.

There were also complaints that the number of pedicabs on some streets was causing traffic jams and some drivers were reckless. On July 4th, a tourist was killed when a pedicab turned too quickly causing her to fall out of the pedicab. She suffered a fatal head injury.

The City’s Traffic Engineering operations and the San Diego Police Department’s Traffic Division scrutinized the current regulations and suggested several revisions to the current ordinance. Some of the amended ordinances include passengers must wear seatbelts, pedicabs are prohibited on sidewalks and streets with speed limits over 25 MPH. Fares
must be posted on all pedicabs, and operators must carry proof of insurance. You can see a complete list of the new regulations at: www.sandiego.gov

The PS&NS Committee is awaiting a legal opinion from the City Attorney on a proposed regulation to restrict the number of pedicabs operator licenses issued. The City Council plans to take that up in September.
